1. Agreement
By creating an account or using Maarkrix you agree to these Terms and to our Privacy Policy. If you use Maarkrix on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. The service
Maarkrix provides an AI-assisted marketing studio that helps you plan, generate and publish content. Features, credits and limits depend on your plan and are described on the pricing page. We may improve, change or discontinue features over time; when a change is material we will notify you.
3. Accounts
- You must be at least 16 years old and provide accurate information.
- You are responsible for activity under your account and for keeping your credentials secure.
- One person or legal entity per account, unless otherwise agreed in writing.
4. Acceptable use
You agree not to:
- Break the law, infringe third-party rights or violate the rights of any person.
- Use Maarkrix to generate deceptive political, medical, financial or legal content, or non-consensual imagery of real people.
- Attempt to bypass authentication, credit limits, rate limits, security or plan restrictions.
- Resell the service, mirror the product, or use it to build a competing model or product.
- Upload malware, illegal content or personal data of others without a lawful basis.
5. Your content and AI output
You retain ownership of the content you submit and, subject to payment and applicable law, of the outputs Maarkrix generates for you from your inputs. You grant Maarkrix a limited licence to process that content solely to operate the service on your behalf. You are responsible for reviewing AI output before publishing — models can make mistakes and Maarkrix does not guarantee accuracy, originality or fitness for a specific use.
6. Plans, credits and payment
- Paid plans are billed monthly or yearly via Stripe in advance and renew automatically until cancelled.
- Each plan includes a monthly credit allowance that is granted on activation and each renewal.
- Consumed credits are non-refundable. Unused credits do not roll over unless we say so in writing.
- You can cancel any time from the billing portal; your plan stays active until the end of the current period.
- We may change pricing on renewal with at least 30 days' notice.
7. Refunds
Except where required by law (for example the EU right of withdrawal within 14 days of first purchase, provided you have not consumed a material portion of your credits), fees are non-refundable.
8. Beta features
Some parts of Maarkrix are marked beta. They are provided as-is, may change or be removed, and may have lower reliability. Do not rely on beta features for mission-critical workflows.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, if your payments fail, or if we are required to do so by law. You may close your account at any time; see the Privacy Policy for what happens to your data.
10. Intellectual property
The Maarkrix brand, website and software are owned by Maarkrix and its licensors and are protected by intellectual-property laws. These Terms do not grant you rights to our trademarks or software beyond the licence to use the service.
11. Disclaimers
To the maximum extent permitted by law, Maarkrix is provided as is and as available, without warranties of any kind — express, implied or statutory — including merchantability, fitness for a particular purpose, non-infringement or accuracy of AI output.
12. Limitation of liability
To the maximum extent permitted by law, Maarkrix's aggregate liability arising out of or in connection with the service is limited to the amount you paid to Maarkrix in the 12 months preceding the event giving rise to the claim. Maarkrix is not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue, goodwill or data.
13. Indemnity
You will defend and indemnify Maarkrix against claims arising from your content, your use of AI output, or your breach of these Terms or applicable law.
14. Changes to the terms
We may update these Terms as the product and applicable law evolve. When we do we update the date at the top and, for material changes, notify you by email or in-app. Continued use after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which Maarkrix is established, without regard to conflict-of-law principles. Mandatory consumer protections in your country of residence still apply.
